CMS creates new system of records for shared savings programs

The Centers for Medicare & Medicaid Services (CMS), in accordance with the requirements of the Privacy Act of 1974, is establishing a new system of records to support its shared savings programs, the first of which are the Medicare Shared Savings Program and Pioneer Accountable Care Organization (ACO) Model.

The ACO model implements recent healthcare reform provisions of the Patient Protection and Affordable Care Act, amending the Social Security Act. The system of records will contain personally identifiable information (PII) about individuals who participate in, or whose PII is used to determine eligibility in an ACO, a shared savings program (i.e., Medicare fee-for-service (FFS) beneficiaries, sole proprietor healthcare ACO participants, ACO suppliers/providers), leaders, managers and contacts at ACOs.

On Sept. 14, CMS filed the new system report with the chair of the House Committee on Government Reform and Oversight, the chair of the Senate Committee on Homeland Security & Governmental Affairs, and the administrator, Office of Information and Regulatory Affairs, Office of Management and Budget.

CMS is seeking public comment on the new system which takes effect October 19. If CMS receives comments that require alterations, a revised notice will be published in the Federal Register.
